South Carolina Supreme Court issues friendly reminder that debtors prisons are illegal - Inside Subprime

South Carolina Supreme Court issues friendly reminder that debtors prisons are illegal - Inside Subprime 11/10/17 South Carolina Supreme Court issues friendly reminder that debtors prisons are illegal South Carolina Supreme Court issues friendly reminder that debtors prisons are illegalInside Subprime: November 10, 2017By Caroline ThompsonDonald Beatty, Chief Justice of the South Carolina Supreme Court, has had enough. Although debtors prisons â€" or the act of keeping someone behind bars for failing to pay fines and fees â€" are barred by the Constitution,  courts around the state have for years been ignoring this fact, convicting people without evidence for failing to show up to court dates, and putting out arrest warrants on impoverished citizens who couldnt afford to pay fines  for low-level violations like traffic tickets. Additionally, many of these erroneously-jailed South Carolinians were never informed of their right to an attorney, leaving them to sit behind bars with  no way to make bail, and no one to speak on their behalf.Last week, Beatty,  spurred by an investigation from the American Civil  Liberties  Union (ACLU) which found that the South Carolina municipalities of Beaufort and Bluffton were able to extract fines from thousands of poor people every year, without ever providing them access to a public defender, issued a firm reminder to to summary court judges that they need to actually follow the letter of the law.It has continually come to my attention that defendants, who are neither represented by counsel nor have waived counsel, are being sentenced to imprisonment, he wrote in a memorandum to South Carolina magistrates and municipal court judges. This is a clear violation of the Sixth Amendment right to counsel and numerous opinions of the Supreme Court of the United States. All defendants facing criminal charges in your courts that carry the possibility of imprisonment must be informed of their right to counsel and, if indigent, their right to court-appointed counsel prior to proceeding with trial. Absent a waiver of counsel, or the appointment of counsel for an indigent defendant, summary court judges shall not impose a sentence of ja il time, and are limited to imposing a sentence of a fine only for those defendants, if convicted. As a result of Beattys order, tens of thousands of arrest warrants for low-level offenses have been thrown out, and judges around the state could face jail time themselves if they fail to comply with the order. According to The Post and Courier, however, many fear this may be bad news for the victims of these crimes, some of which include domestic violence. But  the data proves that the vast majority of these offenders are wanted for nonviolent violations. In fact, a report from Horry County found that, of the 7,500 recalled warrants in the county, more than 4,600 stem from traffic, and just 230  from domestic violence cases.Charleston County Chief Magistrate Leroy Linen agreed with Beattys conclusions,  adding that putting so many people in jail for these kinds of offenses is actually  hurting   â€" not helping â€" the state.“There is so much collateral damage from jailing them,”   Linen said. “We had been doing this practice all over the state, and nobody was saying anything. … (The chief justice) was trying to impress upon everyone that we must … give people their due process rights.”When imposing a fine, consideration should be given to a defendants ability to pay, wrote Beatty. I am mindful of the constraints that you face in your courts, but these principles of due process to all defendants who come before you cannot be abridged.Check out these related pages and articles from OppLoans:The South Carolina Subprime MarketplaceBeware The Scary Debt Monsters! How to Handle an Unexpected BillVisit OppLoans on  YouTube  |  Facebook  |  Twitter  |  LinkedIn

1.0 BUILDING REQUIREMENTS 1.1 HEALTH AND SAFETY Below are details of the statutory regulations and minimum standards that are expected of landlord/persons responsible for the building. 1.1.1 Health Safety Risk Assessment – Annual Under the Health and Safety at Work Act 1974 (the HSW Act), you have to ensure, so far as is reasonably practicable, the HS of yourself and ‘others’ who may be affected by what you do or do not do. It applies to all work activities and premises and everyone at work has responsibilities under it. Employees must take care of their own HS and that of others who may be affected by their actions at work. They must also co-operate with employers and co-workers to help everyone meet their legal requirements. The Management of Health and Safety at Work Regulations 1999 also apply to every work activity and workplace and require all risks to be assessed and, where necessary, controlled. WP would advise to air on the side of caution for minimal cost in the absence of clear regulation; LCM should be carrying out an annual HS Risk Assessment. It is a legal requirement for every employer and self-employed person to make an assessment of the HS risks arising out of their work. The purpose of the assessment is to identify what needs to be done to control HS risks, Regulation 3 of the Management of Health and Safety at Work Regulations 1999. The War Of The Vietnam War - 1660 Words

The atrocities that took place in Vietnam fifty years ago have left physical and mental scars on the people that were afflicted by the war. Regardless of whether an individual was a civilian or a soldier, both experienced horrors. With over 1.3 million casualties, the war has stricken locals in Vietnam, to families across the United States. The majority of Vietnam s history has been a challenge for freedom, whether it was from the Chinese around 900 years AD or the French just after World War II. Vietnamese emperors were powerless and French ruled them with tyranny. In 1890 Nguyen Tat Thanh was born. He was well educated and had aspirations of traveling the world. How Computing Will Help Me as a Nursing Student

Question: How do you think computing will be important for you as a nursing student, and later as a professional? Provide your overall impression of the researchers views on computing in healthcare system. Answer: It was seen in the report that the nurses in Australia do not have much access to the computing system. But they recognize the benefits of the usage of the computing system in the workplace. As a nursing student I will need the computers to help me to prepare for the college coursework and also to take notes. Moreover it will help me in the online teaching, and the computer based learning systems (Hegney, Buikstra and Eley, 2007). The computing system will help me learn the basics of nursing before going to the actual field. I will be able to share the information with my professors, peers and professionals. The hospitals now-a-days uses a computer program to impart teachings to the patients about the various diseases and disease management. The physicians also prescribe the treatments and medications on the computers (Improving Technological Competency in Nursing Students, 2015). The nurses use those for the care of the patients. The nurses may also order the medicines and check the supplies of the medicines. The nurses also use computers to communicate with the physicians about the care of the patients. Moreover the nurses use the computers to keep a record of the documents of the patients health, tests, and routine care. The computing technology can be used in mobile phones, or portable tablets that the nurses carry along with the clip board and the other paper documents. Thus the computing system will help me in getting a thorough knowledge of the coursework since it will help me in getting notes and learn about the ways as to how it will be beneficial in the practical field (Biglari, 2015). The knowledge that I will gain by using the computing system will help me in my professional work. Thus the computing systems need to be incorporated in the education system of nursing. Passions are your desires, wishes, and aspirations and so much more. One of my enormous passions in life is to preserve and carry on the Hawaiian culture. The pre-contact native Hawaiian population has been estimated to as high as one million, and the native population after the overthrow of the Hawaiian monarchy in 1893 was 40,000. Today, the number has dramatically decreased to 8,000 and it is predicted that be the year 2024, pure Hawaiians will no longer exist. Although pure Hawaiians may not exist in the future, my effort to preserve the Hawaiian culture will only grow stronger ad I continue to tell ancient stories of Hawaii through my hula dancing. Every dance I learn is just another step to help preserve a culture whic...

Criminology - Gangs (MS-13) Essay Example | Topics and Well Written Essays - 750 words

Criminology - Gangs (MS-13) - Essay Example However, the stiff affiliation to the group led to the eruption of criminal activities in the American region as the group’s majority members were poor, and executed any criminal act in order to achieve their perceived lifestyles. The perception that the cultural theory influenced the gangs formation emanates from the evidence presented by the video that presents different interviews sourced from the former gang members. It is known that many of the gang members are teenagers while others are as young as eight years old (Siegel & Welsh, 2014). The argument accrued from the information provokes the understanding that the gang embraces the use of criminal ideologies to rob, assassinate, and vandalize properties at the expense of the rival people in the American community (Strippas, 2014). Therefore, the use of the cultural theory is the influential aspect that has led to the rise of illiteracy levels amongst the highly connected criminal organization that has been a menace in the Northern Virginia region amongst other American states (Baumeister & Masicampo, 2010). The Mara Salvatrucha- 13 Gang started in Los-Angeles from the Pico-Union, an organization that comprised Salvadorans who had migrated into America following the Central American civil wars. The 13 numerical sign emanated from the M alphabet, which is the thirteenth alphabet. Arguably, a notorious gangster called Eme initially used the alphabet. It is evident that the social environment influenced a majority of the Salvadorans to embrace the movement as they lived under poor conditions. In the present, the MS-13 Gang’s membership is estimated to comprise a population exceeding 100,000 members who are spread in over 42 states in the U.S.A. The notorious gang is renowned for its use of subculture codes in communication. Further, the gang members bear tattoos on their

Needs and Problem Statement The specific aims is one of the many steps the PEACE Agency will need when requesting a grant. This piece includes as subcategories of the needs and problem statement. This is where the PEACE Domestic Violence Agency will express the importance of knowing what they are doing and why they are doing it. They should state how the city of Portland is experiencing increasing reports of spousal and child abuse, assault, and incidents of road rage, domestic and youth violence, and the effects it has on the people. Then they will summarize how their direct services and education will help the target these areas. A needs and problem statement should be something like this, â€Å"It was not that long ago that what happened at home was considered a private, family matter and was excluded from scrutiny by the public. Within the last few decades, there has been an increase in awareness of the seriousness of child abuse and neglect, spouse/partner abuse, and elder abuse not only as critical societal problems but also as crimes.† When it comes to a literature review this is where data is used to fill and rational what is happening. It tells the history and the current views of the problem or need in order to give the reader a better understanding and appreciation of the problem or need. Program Planning According to our reading, program planning is an organized process where a set of coordinated activities or interventions is developed to address and facilitate change in some or all of the identified problems. (Yuen/Terao, 2003) Program planning is something that never stops every organization uses program planning to continually make thing better. Every organization uses program planning to develop their current program and new programs. All programs planning it is important that you have a goal set bases on the needs and the problems that you are trying to work on. Our text also states, â€Å"Program planning not only concerns what will happen, it also involves the assessment of what has happened and what really would have happened. It is by design and by its very nature related to needs assessment and program evaluation. Needs or problems assessment is the necessary and fundamental  step for any successful program planning.† (Yuen/Terao, 2003) â€Å"A program and evaluation of a program are not separate activities. When planned carefully, these two set of activities can be integrated into an organized set of ongoing operations that promote and support each other.† (Mika, 1996, p. 6) Alternative Funding The PEACE Domestic Violence agency needs to look at way to find funding especially when detecting the demanding needs of funding and present unbearable conditions. The PEACE Domestic Violence agency normal gets their funding form grants issued by the National Foundation funding Program. With this funding, the agency will move forward and continue to make an effort when they are trying to reach its objective which is promoting the safety of young men, women and children whose lively-hood not on relies on it, nevertheless they are subjective by domestic violence on a day to day basis. The objective is to lessen the numbers of domestic violence attach through education, heightened awareness, and service requirement. The PEACE Domestic Violence agency will always want to continue submitting applications to their â€Å"Stakeholders Program†. When it comes to a funding course that is set up to supporting many other businesses that are under the same objective within the Supporting F amilies plan this takes about three years and can produce $150,000 yearly. Implementation When someone wants to build a human service organization, they will need the data collected from numerous programs with the initial organization planning. They will need to provide objectives for issues that surround the project and an outline of how to ultimately reach the goal of building this system for an operational organization that is attributed by many stages such as: Phase I: Categorized documentation of instructions for the project Law enforcement cases of any domestic violence statistics for the region, the targeted culture, or ethnicity, age group, and complaint numbers for issue (HHS, 2014). Phase II: Member forms a quantitative research data for the project to commence. Phase III: Gather information for the victims who contributed in the study along with any criticism to decide a cause or constancy. Phase IV: A series of ethnographic inquiries of incidences that will need to be used in future projects that intention to qualitative data  research taken in long-term views to provide the efficiency of the programs. Phase V: Logs of all activity, related documents, meetings, project bids for the quantitative data analysis for its demographic approach. Furthermore, the recovery in the evaluation team, they will look into the damage peace, the internal perspective of a clinician practitioner, and a psychological expert. (HHS, 2014) The PEACE of Domestic Violence agency will make sure the confidentiality of the facts given by the individual in the study, and the supervisor stores all the data on files only for the evaluation team to view. There are legal things that need complying with along with ethics and processes that the state requires. The foundation of the budget report having the monthly expenses being seven thousand dollars that will pay off short-term employees of one manager and six employees, victim resources, and office supplies. There will be a forty percent grant to help the organization of the Stakeholder Program covering an annual seventy one thousand dollars. Regarding the need supporting the assets and the catastrophic, the agency needs the National Foundation for its organization aid. The agency will promotes safety for domestic violence victims and their families and aid each potential avenue that supports the objective. There will be fewer incidences of violence with the implementing of positive education, and precautionary training. The PEACE agency will continue with an investment for the program, by providing support given by separate corporations for the supportable program that will cover three years and roughly one hundred twenty five thousand dollars per year. The PEACE Domestic Violence Agency recommends the grant to cover the costs of servicing, administration, and population parameters. The money for the infrastructure of the organization resources include; operating costs, wage compensation, transportation, and legal assistance (HHS, 2014). Evaluation The evaluation plan for the PEACE Domestic Violence Agency will be a project-wide evaluation using the empowerment methodology. This form of evaluation plan will work seamlessly with the agency’s domestic violence program since it provides structure for the big picture and focuses on the tenacity of the program. As well as it involves program staff in the evaluation development and implementation, this enables them to feel invested in the program. The first phase in developing this type of plan is  to â€Å"identify the answer to the big question†. (Yuen Terao, 2003, p.53) Therefore, in the case of the PEACE agency, it would be finding out whether or not the instances of domestic violence can be reduced and in what way. Another question could be whether educating people about domestic violence plays a key role in stopping it. Our evaluation plan will include both process and outcome evaluation by getting the papers of activities made, and assembly the material from a wide-ranging of sources to allow the agency to indicate â€Å"what benefits were achieved as a result of the services provided† (Yuen Terao, 2003, p.53). PEACE Domestic Violence Agency is going to have to evaluate what programs are helping these families and individuals on monthly bases. If there is part of their program that is not helping or that could us more focus they need to know as soon as possible this way they can focus on other things. An example would be if the there is not a prison they may not need to focus as much on the helping of prisoner families compared to the crime has gone up in the area over domestic violence so they need to focus more on those programs within their organization. Knowing where to focus their strengths in is most agencies battle therefore good planning and evaluations it where you need to really pay close attention to. Conclusion Each year, too many people have been affected and are still being affected by violence, abuse, and rage. According to Rotary Club of Portland, â€Å"more than 1 in 3 women and 1 in 4 men in the U.S. are physically, emotionally, or sexually abused in their lifetime. Domestic violence affects people of all ages, race, ethnicity, socio-economic status, and sexual orientation. You have already met numerous survivors of abuse. They are all around you.† (Designs, 2012) Statistics like these can be found all over the country but ever since the factories shut down, the residents of the city of Portland have experienced a higher increase of such incidents. Ignoring this sudden steady increase of violence, abuse, and rage in the city of Portland will destroy the families that make Portland what it is. The children will grow up witnessing all types of violence and abuse and will increase their likelihood to become abusers themselves. Stepping in now will help teach the community that domestic abuse is not acceptable for any reason. The victims of abuse will have help in recovery and a chance to break the cycle from continuing on to the next generation. There has been some success in  decreasing incidents of abuse through education. Counseling has also been effective in helping victims become survivors. These methods will be successful in Portland as well. The PEACE Domestic Violence Agency intend to add some self-help classes to overcome potential barriers of culture and stress but our most promising intervention will be our shelter. This will provide a way out for the victims who feel trapped. References Designs, E. (2012). Domestic Violence Solutions . McMurphy, Rebel with a Cause in Ken Keseys One Flew Over the Cuckoos Nest :: One Flew Over Cuckoos Nest

McMurphy, Rebel with a Cause in One Flew Over The Cuckoo's Nest Ken Kesey's experiences in a mental institution urged him to tell the story of such a ward. We are told this story through the eyes of a huge red Indian who everyone believes to be deaf and dumb named Chief in his novel "One Flew Over The Cuckoo's Nest". Chief is a patient in an Oregon psychiatric hospital on the ward of Mrs Ratched. she is the symbol of authority throughout the text. This ward forms the backdrop for the rest of the story. The men on the ward are resigned to their regime dictated by this tyrant who is referred to as 'the Big Nurse', until McMurphy arrives to disrupt it. He makes the men realise that it is possible to think for themselves, which results in a complete destruction of the system as it was. Randle P. McMurphy, a wrongly committed mental patient with a lust for life. The qualities that garner McMurphy respect and admiration from his fellow patients are also responsible for his tragic downfall. These qualities include his temper, which leads to his being deemed "disturbed," his stubbornness, which results in his receiving numerous painful disciplinary treatments, and finally his free spirit, which leads to his death. Despite McMurphy being a noble man, in the end, these characteristics hurt him more than they help him. He forms the basis to my study of rebellion. The Narrator, Chief Bromden comments that it was not he who originally decided to adopt the act of being deaf and dumb but others who treated him as if he were deaf and dumb, which illustrates that the way a person is depends upon the society around him. Indeed, Chief Bromden's father told him: "If you don't watch it people will force you one way or the other into doing what they think you should do, or into just being mule-stubborn and doing the opposite just out of spite." This is very much emphasised in the book: Kesey strongly suggests that the residents of the ward in his novel are there because they could not cope with the pressures put on them by society to conform, and that their madness is caused by others, rather than originating within the men themselves.

Warren Buffet and the Company

Relation between   Selected from Financial ReviewWarren Buffet, CEO of Berkshire Hathaway, is one of the most successful investors and business executives of all time. He has invested in many industries which can be seen in the following figure:Figure 1: Warren Buffett's Portfolio (Source: gurufocus, 2018)From the above graph, we can see that the sectors that Warren Buffet has invested are quite similar to the sectors that we have selected. Buffet has invested most (i.e. 42.6%) on the financial services. Likewise, we have also selected one of the companies from the financial sector i.e. National Australian Bank. In terms of their value of ordinary shares using PE ratio valuation model, we have ranked National Australian Bank on the third position as per our desirability to invest. Similarly, in the above table, we can see that Buffett has invested 23.4 % of their investment in consumer defensive product. Likewise, among ten, two of the companies that we have selected are also from consumer defensive sector i.e. Woolworths and Coca Cola. Like everyone, we very well know that Coca Cola is the favorite stock of Buffett. Frankel (2017) also indicated that the company of Buffett i.e. Berkshire Hathaway owns US 16.7 billion dollar worth of share of Coca Cola, making this company the third largest stock investment of Buffett. In the above figure, we can also see that Buffett has invested 4.3% on the energy sector. We have also selected three companies from the energy sector and ranked the AGL Energy on the top list of our desirability to invest as this company has got the highest value of ordinary share from PE ratio valuation Model. Since real estates and EFT, options, preferred are the least invested company as per the Warren Buffett's portfolio, it seems we are quite similar in that field, as we also have not chosen any companies from those sectors. 5. Comparison between Warren Buffet's Approach and Share Valuation Techniques used in the ReportWarren Buffet uses various approaches to estimate the value of shares, such as, earning yield, historical earning growth and sustainable growth. Buffett uses earning yield approach as it represents the rate of return which can be used to compare with other investment more quickly. Buffet normally compares the earning yield of a company with long term government bond yield and selects the one which earning yield is near to the government bond yield. In terms of historical earning approach, Buffett project the annual compound rate of return on the basis of historical earnings per share increased. The next approach of Buffett is based on the sustainable growth rate model where he utilizes the average rate of return on equity and average retention ratio so as to calculate the sustainable growth rate (Bajkowsi, n.d.).Sustainable growth model approach of Warren Buffett is similar to one of the share valuation techniques used in week 6- Chapter 10 i.e. P/E ratio valuation model. It is because, according to Bajkowsi, the sustainable growth rate is utilize to estimate the book value per share in year ten and earnings per share can be measured in year 10 by multiplying the average return on equity with the projected book value per share. Then, estimate earning per share is multiplied with average P/E ratio to get the future price. Therefore, we prefer to use the P/E ratio valuation model because it is also one of the approaches used by the best investor of the world, Warren Buffet. 6. RecommendationIn terms of company, it is very wise to invest in AGL Energy Company as this company has the highest value of ordinary shares from P/E ratio valuation model compare to others. In terms of approaches and techniques regarding share valuation, it is wise to go for PE ratio valuation model. When making the investment decision, it is very useful to follow the techniques and approaches used by the best investor of the world, Warren Buffett, as his experience, techniques and approaches can be very well utilized to select the best investments.7. ConclusionTherefore, in terms of investments, we have come to conclusion that we will be investing in AGL Energy Company as it has the highest value of ordinary share from PE ratio valuation model which is also highly utilized by Warren Buffet in terms of his share valuation. Warren Buffet is one of the best valued investor of the world, thus, it is very wise to follow the approach and techniques used by the Warren Buffet. Warren Buffett has invested most on the financial and Consumer defensive sector, thus, apart from AGL Energy, the companies that have occupied the second and third position in terms of our desirability to invest are Woolworths and National Australia Bank. Though there are various share valuation approached used by Warren Buffet and mentioned in our week 6-chapter 10, we prefer to use PE ratio valuation model as this approaches also helps to compare the prices of the firms in the same area of economy (Kennon, 2018).

5 Ways to Eliminate Deadwood for Direct and Concise Writing

I believe more in the scissors than I do in the pencil, Truman Capote once said. In other words, what we cut out of our writing is sometimes more important than what we put in. So lets continue to cut the clutter. How do we stop wasting words and get to the point? Here are five more strategies to apply when revising and editing essays, memos, and reports. Use Active Verbs Whenever possible, make the subject of a sentence do something. Wordy: The grant proposals were reviewed by the students.Revised: The students reviewed the grant proposals. Dont Try to Show Off As Leonardo da Vinci observed, Simplicity is the ultimate sophistication. Dont presume that big words or lengthy phrases will impress your readers: often the simplest word is the best. Wordy: At this moment in time, students who are matriculating through high school should be empowered to participate in the voting process.Revised: High school students should have the right to vote. Cut Empty Phrases Some of the most common phrases mean little, if anything, and should be cut from our writing: all things being equalall things consideredas a matter of factas far as I am concernedat the end of the dayat the present timedue to the fact thatfor all intents and purposesfor the most partfor the purpose ofin a manner of speakingin my opinionin the event ofin the final analysisit seems thatthe point that I am trying to maketype ofwhat I am trying to saywhat I want to make clear Wordy: All things being equal, what I am trying to say is that in my opinion all students should, in the final analysis, have the right to vote for all intents and purposes.Revised: Students should have the right to vote. Avoid Using Noun Forms of Verbs The fancy name for this process is excessive nominalization. Our advice is simple: give verbs a chance. Wordy: The presentation of the arguments by the students was convincing.Revised: The students presented their arguments convincingly. Or . . .The students argued convincingly. Replace Vague Nouns Replace vague nouns (such as area, aspect, case, factor, manner, situation, something, thing, type, and way) with more specific words—or eliminate them altogether. Wordy: After reading several things in the area of psychology-type subjects, I decided to put myself in a situation where I might change my major.Revised: After reading several psychology books, I decided to change my major.
